checklist
- contact the facility's administrator to flag the concern — facilities have a legal obligation to investigate financial exploitation under OBRA regulations.
- preserve all bank statements for the resident's accounts for the past 24 months — look for recurring transfers, ATM withdrawals, or payees the resident did not authorize.
- pull the power of attorney document — note the granting date, scope of authority, and whether the resident had capacity when it was signed.
- export the facility's billing and payment records — look for discrepancies between the resident's personal account withdrawals and what the facility actually billed.
- preserve any caregiver device exports or visitation logs if the facility tracks them — exploitation often clusters around specific caregiver shifts.
- note whether the resident's beneficiary designations or will have changed since the alleged exploitation began.
- pull Medicare / Medicaid billing records for the resident — fraudulent billing by facilities is a separate track from personal financial exploitation.
- contact Adult Protective Services (APS) — most states require facilities to report suspected exploitation; a private report to APS runs in parallel.
- contact the Long-Term Care Ombudsman for the state — ombudsmen have access rights and can request records on behalf of residents.
